Welcome to H2ITEX.CA (hereinafter referred to as the "Website")
Please read the following terms and conditions carefully; they bind you to the Merchant, owner of the Website. Furthermore, you agree to communicate with the Merchant electronically for all your exchanges and that these exchanges meet the requirements of a written communication.
We reserve the right to refuse service, cancel an order, terminate your account, remove or edit content from the Site, or cancel an order, whether or not you have complied with these Terms and Conditions.

Confidentiality of personal information
Please refer to our privacy policy available in the footer of our site to learn how we collect, share and manage your personal information.
The products and services offered are intended to be sold to adults in their place of residence, which is 18 years old in the province of Quebec. By using the Merchant Site, you represent and warrant that you are of the age of majority in your place of residence.
Accuracy of Information
We make every effort to ensure that all information posted on our Site is free of error, but we cannot guarantee this. We may refuse or cancel an order containing an item with an incorrect description or price. Unless otherwise indicated, prices are quoted in Canadian currency.
The products offered on our Site, as well as the dates of offers, prices and availability, features and technical specifications of these products, are subject to revision and change without notice. It is possible that a product ordered online is no longer available in our inventory or that it cannot be delivered due to a situation beyond our control. In such a case, we will cancel the order and refund the money paid for the product.
Your only recourse in the event that a product is not as described is to return it in its original packaging for a refund, in accordance with the refund provisions below.
Registration and Password
You will be required to complete a registration form to access certain areas and features of the Merchant Site. You agree to provide us with current and truthful information and to keep such information current at all times.
You agree to protect the confidentiality of your user name and password, and access to your computer, so that no one but you will use them. You are responsible for all transactions that occur under your account using this information. You shall notify us immediately of any unauthorized use of your user name and password, and any breach of security of which you are aware, within forty-eight (48) hours of becoming aware.
Comments
You may post comments and reviews regarding the content of the Site. You are entirely responsible for the comments you post, we will not be held liable for them, and you agree to indemnify the Merchant against any damages arising from them.
You may not make comments on behalf of others, conceal your identity, or make comments that are unlawful, obscene, threatening, defamatory, invasive of another's privacy or intellectual property, or that constitute chain letters, mass mailings or spam.
We reserve the right, but are not obligated, to edit or remove comments without explanation, and we assume no responsibility for systematically reviewing posted comments.
When you post a comment, you grant Merchant a non-exclusive, royalty-free, perpetual and irrevocable right to use the name and content posted, to reproduce, modify, adapt, publish, perform, translate, broadcast, communicate to the public, and display it anywhere in the world in any medium.
We ask you to publish only one review per product, except if you wish to add new information. You agree to only review products that you have personally tried and to maintain a respectful tone at all times. Employees and competitors of distributors and manufacturers are prohibited from posting reviews.
Governing Law
These terms and conditions are governed by the laws of the province of Quebec, and the laws of Canada, as applicable. In addition, any legal action against the Merchant must be brought in the judicial district in which the city of Brossard is located.
ORDERING ERRORS
In the event that you believe that an error occurred during the placement of an order, we invite you to notify us without delay, at the latest within 48 hours of its discovery by writing to us at the following address: info@h2itex.ca and describing in detail the error committed.
DELIVERIES AND RETURNS
Unless you have selected a specific carrier and delivery time at the time of the transaction for which additional charges may apply, the method of delivery and the name of the carrier will be determined by the Merchant and our usual delivery time in your territory is : 10 days or less.
We undertake to deliver your purchases within a reasonable time, subject to the availability of the carriers used by the shipper, who are solely responsible for the delivery of the products or services purchased.
Risk of loss and title to the goods or services purchased pass to you at the time the goods are delivered to the carrier or, if the goods cross an international border, such risk passes to you after customs clearance.
In-store pickup of a purchase made online must be done during normal business hours.
In this case, the risk of loss and ownership of the item purchased passes to you at the time you pick it up at the store.
CANCELLATION, EXCHANGE, TERMINATION, RETURN OR REFUND POLICY
Cancellations of orders that are correct and without error are not permitted.
Exchanges are not permitted.
Limitation of Warranty
SUBJECT TO APPLICABLE LAW, MERCHANT DISCLAIMS ALL WARRANTIES OR CONDITIONS, EXPRESS OR IMPLIED, AS TO THE TITLE, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OF PRODUCTS AND SERVICES SOLD ON THE SITE. IT ALSO DISCLAIMS ANY WARRANTY OR CONDITION, EXPRESS OR IMPLIED, IN THE CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR OTHER SERVICES INCLUDED ON OR THROUGH THE SITE AND ON ITS SERVERS AND IN ELECTRONIC COMMUNICATIONS.
Limitation of Liability
MERCHANT SHALL NOT BE LIABLE FOR ANY DIRECT OR INDIRECT DAMAGES RESULTING FROM THE USE OR MISUSE OF THE SITE OR FOR THE PURCHASE OF GOODS ON IT, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFIT, USE OF DATA OR OTHER INTANGIBLES, EVEN IF MERCHANT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Copyrights
The copyrights and trademarks contained in the information published on the Site are protected by intellectual property laws and are made available on the Site by granting a specific license in this regard.
In accordance with applicable intellectual property laws, it is prohibited to use, display or exhibit any trademark, copyright or other protected work available on the Site for any purpose other than to conduct the sale of such products and services without the right to sublicense to others. The owners of the marks appearing on the Site retain all rights not expressly granted in these Terms and Conditions.
If you have reason to believe that the Terms and Conditions have been violated, or that your work has been copied or is being used on our Site in a manner that infringes your intellectual property rights, please notify us as soon as possible by writing to us at info@rubiica.ca and describing in detail the infringement that has occurred.

INTRODUCTION
Welcome to the h2itex.ca/shop (hereinafter: the "Site"). This document deals with the policy of Concept H2-ITEX Inc. which operates the Site with respect to the protection of personal information. This policy is based on the laws in force in Canada, in the Personal Information Protection and Electronic Documents Act and the Act respecting the protection of personal information in the private sector (R.S.Q., chapter P-39.1) in the province of Quebec, where the head office of the company is located. Information collected about you may include, but is not limited to, your name, company name, mailing address, telephone number, email address, fax number, age, cookies, IP addresses, billing address, credit card number and expiration date, etc. We also collect information about your use of the Site, including the dates and times of your visits, the pages you view, the documents you download, the type of web browser you use during your visit, and your electronic communications with us (including e-mail and chat).
